Marx Companies, LLC dba MarxFoods.com guarantees that my order will arrive in excellent condition. Because of the nature of its products, MarxFoods.com generally does not accept returns. In the event that I am not satisfied with the products that I purchase from Marxfoods.com, then, within 24 hours after my receipt of my order, I will:
1) Email sales@marxfoods.com or call (206) 447-1818 to report, with reasonable specificity, my dissatisfaction to Marx Foods;
2) Take a digital photograph of the products; and
3) Store the products in my refrigerator or freezer if they are fresh or frozen products.
I agree that the decision to issue a return, refund or allowance is at the sole discretion of Marxfoods.com. I acknowledge that my order contains products that must be stored at certain temperatures, and I agree to accept delivery of all products that I order from MarxFoods.com. I understand and agree that I will not be entitled to any return, refund, or allowance if there was no one present to receive my delivery at the shipping address on the designated delivery date I provided on the “Review and Submit Order” screen when placing my order.
I agree that any refund issued by MarxFoods.com will be credited to the same credit card I used to make my purchase. By placing my order, I represent that I am authorized to use the designated credit card and I authorize MarxFoods.com to charge my order (including taxes, shipping, handling and any amounts described on the MarxFoods.com website) to that card. If, after placing my order, I contact MarxFoods.com by phone, email, or otherwise to add any item or items to my order, I authorize MarxFoods.com to charge any such additional amounts to the designated credit card. I understand that MarxFoods.com will keep my designated credit card on file until its expiration date and I further authorize MarxFoods.com to charge my future orders to this card and subject to these Terms & Conditions, unless I indicate otherwise in writing. I understand that if my designated credit card cannot be verified, is invalid, or is not otherwise acceptable, my order (or any future orders) may be suspended or cancelled automatically.
I acknowledge that my purchase of all products is subject to availability and that MarxFoods.com reserves the right to impose quantity limits on any order, to reject all or part of an order, and to discontinue products or services without notice. I understand that frozen products occasionally defrost slightly during shipment and I will accept such slight thaws should they occur. I also agree that if I place an order and subsequently cancel it, MarxFoods.com may at its sole discretion, charge both a 10% cancellation/re-stocking fee and a shipping fee equivalent to the freight charge to return the product.
The laws of the state of Washington, without regard to the conflict of law principles thereof, shall govern any dispute arising out of these Terms & Conditions, the sale or shipment or any products from MarxFoods.com to me, or the business relationship between me and MarxFoods.com. All such disputes shall be settled in Seattle, Washington by arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules, and judgment on the award rendered by the arbitrator(s) shall be binding, conclusive and not appealable and may be entered in any court having jurisdiction thereof. Arbitration will occur no later than thirty (30) days after referral and must be concluded within thirty (30) days with hearing to last no more than two (2) full hearing days with one day allotted to each party. There will be no discovery permitted and written submissions shall be limited to ten (10) pages. In no event, however, shall arbitration be available pursuant to this Section after the date when institution of legal or equitable proceedings based on such claim, dispute, or other matter in question would be barred by the applicable statute of limitations.
